If the user does not agree with the conditions set forth herein, they must refrain from accessing and using the website.
The user of the website agrees to use it appropriately, not to use it for activities contrary to the law or good faith, and not to cause damage to the physical and logical systems of T. SPAIN, S.L.
2. Purpose of the florestore.com website:
- To offer visitors content related to our brand, products, services, advertising, and more.
- To allow users to purchase ONLINE the products and services offered directly by Florestore or by third parties it may contract to provide them.
- To track orders placed through this website, access notifications related to shipments, and respond to such notifications.
3. Online Purchase Conditions:
Purchases made through this website, even when a purchase number is provided, will not be considered accepted by T. SPAIN, S.L. until they have been verified and confirmed by issuing the corresponding invoice. The automatic order confirmation sent by email does not imply acceptance on our part. If not accepted, Florestore will have no obligation other than to refund any amount prepaid by the customer, using the same payment method used.
These conditions apply regardless of the sales channel unless otherwise indicated.
The user is informed and accepts that the offers on this website may differ from those available by phone or in physical stores, and that such offers are subject to change at any time without prior notice. Furthermore, the user is informed that the availability of each offer on this website is limited to the period during which it remains published and that such offers may vary depending on the destination, delivery date, and how far in advance the purchase is made.
The user is informed that the content, products, and services are exclusively intended for individuals legally capable of entering into contracts under the applicable laws at their access location. Likewise, the user is warned that the use of this website is prohibited in jurisdictions where the usage terms conflict with local regulations. In such cases, the user or their legal representative will be solely responsible.
4. Steps for Contract Conclusion According to Article 27.1 of Law 34/2002:
- Select product.
- Enter province, city, and desired delivery date.
- Select color, model, and/or accessories if applicable.
- Enter delivery information (name, address, etc.), as well as your personal and billing details.
- Select preferred payment method.
- Once your order proposal is received, it will be subject to acceptance after being reviewed by an operator and the feasibility of the selected items—considering features, delivery date, and destination—is confirmed.
- Once accepted and payment is confirmed, your order will move to the status "Paid and Pending Delivery."
- On the agreed delivery date, delivery will be made and your order will move to the status "Delivered."
- Any issues that may arise will be handled according to the provisions in these general terms and conditions.
- The order will be electronically stored in a file maintained by T. SPAIN, S.L. and accessible to you by entering your email and password.
- If you wish, you can exercise your right to rectification, modification, or cancellation of the order data by sending an email to info@florestore.com or a certified letter to T. SPAIN, S.L., located at Avda. Europa, 5, 29003 MÁLAGA.
- The contract will be formalized in SPANISH.
5. About Our Services
To efficiently handle demand throughout Spain, Florestore offers three types of services, automatically assigned to each order based on product, destination, delivery date, and advance notice. These are described below:
5.1 Own Service
- Florestore staff prepare and deliver your gift.
- Orders can be processed and delivered within just 2–3 hours.
- Once the gift is delivered, you will receive a confirmation SMS. If the order was placed online, you can view a photo of the delivered product in the tracking section. Otherwise, the photo will be sent via WhatsApp the next day, unless prevented by technical issues.
5.2 Shared Service
This service is used when Florestore prepares your gift, but delivery is carried out by a courier service. It is ideal for deliveries to any city in mainland Spain and requires at least one business day's notice.
- The courier service MRW may notify you of the shipment status via SMS.
- Before the product leaves our facility, we take a photo of the order, which is made available to you whenever possible.
5.3 External Service
This service is designed for same-day deliveries or shipments to the Islands, Ceuta, and Melilla. In these cases, Florestore partners with independent local florists to prepare and deliver the orders.
- This service enables deliveries within 3–4 hours of the request in most Spanish cities, ensuring product freshness and quality.
- Bouquets are arranged according to the local style and tradition of the delivery area.
- The delivered product may differ from the photo shown on our website, as each florist uses locally available materials and applies their own style.
- Due to the speed required by this service, it is generally not possible to provide a photo of the delivered product.
Florestore tracks deliveries and sends a confirmation SMS once completed. This allows us to efficiently handle urgent deliveries across Spain, adapting to your needs and ensuring the best experience regardless of destination or order characteristics.
6. About Our Products:
Floral arrangements are handcrafted by skilled florists using flowers that naturally vary and whose availability depends on the season. Therefore, it is impossible for them to be identical to the sample photos shown on our website.
It is especially important to note that funeral products or those requiring same-day delivery must be prepared on the spot anywhere in Spain. These products may vary based on the availability of flowers and accessories at the time and location of the order.
As a guarantee, we will provide a photo of your gift whenever possible. See section "8. Photo of My Order."
7. Product Customization:
All our exclusive products are personalized with the recipient’s name and a sealed envelope containing your printed message.
Products not prepared directly by Florestore will not include this customization. In that case, your message will be handwritten.
The message may not contain insults, threats, or any offensive or illegal content. If inappropriate content is detected, it will be deleted in full or in part. In all cases, the person providing the message will be solely responsible for its content.
8. Photo of My Order:
Our exclusive products, once they leave the florist, go to Florestore's photography studio, where we take a snapshot that will later be made available to the customer and/or gift recipient completely free of charge.
This photograph is taken to show the customer the quality and presentation of the gift we deliver on their behalf, as in many cases the sender does not get to see the product they purchased.
This photograph will never be a catalog image. That is, the photo we will show you will, in all possible cases, be exactly of the product delivered. If that is not possible, we simply won’t show any photo.
This is a value-added service completely FREE of charge for customers and recipients, but it cannot always be offered. Florestore will only provide it when technically and logistically feasible, with no obligation on our part.
9. Flower Guarantee:
Florestore guarantees that the delivered flowers meet appropriate quality standards and are in good condition and freshness at the time of delivery. Since these are natural, perishable products subject to external conditions beyond Florestore's control, such as temperature, handling, or post-delivery care, we offer no guarantee regarding their longevity beyond delivery.
Any claim regarding the condition of the flowers must be made by the customer within a maximum of twenty-four (24) hours from delivery and must include photographic proof of the entire product. After this period, no claims will be accepted, except for hidden defects duly justified and attributable to Florestore.
Damages resulting from improper handling, lack of hydration, exposure to extreme conditions, or any other negligent use of the product after delivery are explicitly excluded from the guarantee.
10. Balloon Guarantee:
For gifts that consist of or contain balloons, our guarantee is limited to the moment of delivery. That is, we cannot be held responsible for their longevity after delivery due to their high fragility, which depends primarily on how they are handled. In this sense, the period to make a claim ends once the balloons have left our store or been delivered.
11. Order Cancellation:
Order cancellations requested by the customer and approved by us will incur a management fee of €5, as long as it is requested before preparation begins (at least 48 hours before the requested delivery date). Once preparation has begun, no refund will be issued, although delivery may be postponed while the flowers remain in suitable condition (1–2 days).
12. Right of Withdrawal
In accordance with current regulations, you have the right to withdraw from your purchase within 14 calendar days from product receipt, except in the following cases where the right does not apply:
- Personalized products or those made to order (e.g., embroidered items, custom floral arrangements, etc.).
- Products that by their nature may deteriorate or expire quickly (e.g., flowers, plants, or balloons).
How to exercise your right of withdrawal
To exercise your right, you must notify us clearly by email or postal mail:

You must include the following information:
- Order number.
- Full name and contact details.
- Order receipt date.
Once we receive your request, we will inform you of the steps to return the product, if applicable. Refunds for withdrawal will be made using the same payment method, once the item has been received at the address above in the same packaging and condition in which it was delivered.
Return shipping costs will be borne by the customer, who must handle the return using the method of their choice.
13. Return Conditions
Product returns will only be accepted in the following cases:
- Products delivered in poor condition or damaged.
- Error in the item delivered, except for variations in color and/or type of flowers due to seasonality or availability at the time of preparation.
Requirements to process a return:
- Report the issue within 24 hours of receiving the order.
- Send clear photographs showing all products at the time of delivery, including packaging, allowing the complete arrangement to be seen. Macros or photos focusing only on a specific part of the arrangement will not be accepted.
Once the issue is verified and resolved in favor of the customer, they may choose between:
- A. A new product sent at no additional cost.
- B. A voucher for the full amount of the damaged or incorrect items for future purchases.
No claims for damaged or defective products will be accepted after 24 hours from the time of delivery.
14. Delays or Inability to Deliver Orders
Florestore will make every effort to meet the delivery date and time requested by the customer. However, certain circumstances completely beyond the control of Florestore may prevent it. Some examples include:
- Incorrect, inaccurate, or incomplete delivery address provided.
- The recipient or any other person is not present at the address or refuses to accept the delivery.
- The destination is an institution, hospital, school, business, funeral home, or any location that restricts access or delivery.
- The order was not placed at least 48 hours in advance of the requested delivery date, or 72 hours in advance on special dates (Valentine's Day, Mother’s Day, Sant Jordi, etc.).
- Local, regional, or national holidays; the customer must check that the delivery date is not a holiday.
- Adverse weather conditions.
- Restrictions imposed by competent authorities.
- Accidents or road/street closures.
- Strikes.
- Other force majeure events or circumstances beyond Florestore's control or that of its partners.
In such cases, we will attempt to contact the recipient using the phone number provided. If there is no response and delivery is possible (e.g., leaving it with a receptionist, neighbor, shop, or any authorized party), we will proceed. Otherwise, we will provide an address where the recipient can pick up the gift within 72 hours and await further instructions from the recipient or client.
The recipient or customer has an additional 24 hours to give new delivery instructions (limited to the same address or postal code). Additional delivery attempts may incur extra costs. If 72 hours pass without response, the service will be considered completed, no refund will be granted, and the product will be discarded.
Under no circumstances will refunds be given for undelivered orders due to reasons beyond our control, nor will the order be canceled or postponed due to the perishable nature of the products.
If the delivery delay is attributable to Florestore or the courier company, compensation may apply as follows:
- If delivered outside the selected time slot but on the requested day, the customer may request a refund of the delivery fee by emailing info@florestore.com.
- If delivered on a later date, the customer may request a 25% refund of the total order amount per business day of delay, up to a maximum of 100%, including shipping costs.
Refusal to accept the delivery will be considered as delivery made for the purposes of calculating any delay.
Refunds will be issued as store credit for the corresponding amount, usable for future purchases with no expiration date.
15. Customer Communications:
Once your order is placed, the system will automatically send you an email with the order details. You will then receive subsequent automatic emails as your order status changes and with the corresponding invoice.
We may also call you on the provided mobile number or email you to confirm any details, inform you of any issues, or collect payment if you have chosen to pay by phone.
If we are unable to reach you or receive no response in time, Florestore will make the decision it deems most appropriate to ensure your order is delivered in the best possible way. This decision will be final and binding, as it will be made in the absence of the instructions we requested and which, for any reason, you did not provide in time.
Typical issue example: You requested a teddy bear with your roses, but it is unavailable. If we do not receive your instructions, we will decide whether to refund the corresponding amount, replace it with another teddy bear of the same value, or substitute it with a box of chocolates, etc., of equal or greater value.
If, for any reason, you do not wish to receive any SMS messages, not even the delivery confirmation, you must state this explicitly in the order comments.
16. Intellectual Property
Florestore owns the intellectual property rights of all content on this website. Reproduction, distribution, public communication, and transformation are strictly prohibited without prior written authorization. Infringements will be sanctioned according to intellectual property laws.
Browsing the website does not imply any transfer of rights to the user.
Additionally, all trade names, trademarks, or distinctive signs displayed on this website are legally protected and duly registered. Violations of industrial property laws will be punished according to current legislation.
17. Privacy and Data Protection Policy:
Please consult our Privacy Policy, which forms an integral part of these general conditions and is expressly acknowledged and accepted by the customer as a prerequisite for placing an order.
18. Disclaimer of Liability:
Florestore accepts no responsibility for:
- Incorrect use of the website's contents or technical issues experienced by users while browsing.
- Damages caused by users providing false, incorrect, or third-party data that violate privacy or other rights.
- Security errors caused by infected devices or outdated browsers that affect functionality, or misuse of browsers.
- Links to external websites do not imply endorsement or responsibility for their content or any damages they may cause.
- Florestore cannot control how third parties use this website and is not responsible for any misuse or legal violations by users.
- Florestore accepts no liability for fraudulent use of credit or debit cards by third parties to pay for products or services.

Regardless of the customer’s location when accessing or ordering from the site, any dispute regarding the existence, access, use, or content of these terms will be exclusively handled by the courts of Málaga, unless consumer protection laws dictate otherwise.
